I was thinking of cancelling Windows 7 I ordered with my laptop and then just downloading the Windows 8 preview. Would I even be able to download it without an OS?

yes if you have a laptop as a spare, or if you can go to a friend's house, otherwise no. Bear in mind that Win8 is likely to be released around sept time taking into acount a 4 year lifecycle for Win OS.

You'll need it to download Win8 other than that, you can install it on a brand new HDD. You dont need another OS pre installed :)
When you asked: "Would I even be able to download it without an OS?" I thought you meant download, not install.

Download the ISO, burn it to a CD, install it on your system.

Of course at some point it will stop working and you'll need a legitimate copy of Windows - or use Linux.
