I would forward that to Nvidia and ask for their help in resolving the issue with you in that case.

Yes it seems as though they are washing their hands from any responsibility (which is fair-play imo) so I will forward this to Nvidia, see what they say (if anything)

PS I swapped my card for a new GTX 970 but problems persist =(

any kind of negotiation about it at the moment. I won't post the replies I have had from them. So I guess
we will have to see. The card does work fine so it would seem, however, legally, there has been a deception,
not necessarily by PC S or Palit, but someone has deceived end users, whether intentionally or not.

I would contact Nvidia directly. I am surprised Palit is unwilling to offer refunds considering other manufacturers are, you can't really blame PCS since they are bound to what their suppliers tell them which in this case is palit.

I read somewhere that it was a miss communication between the Public Advertising Department and the Technical Department of Nvidia.

The configuration pages quotes a 4GB GTX 970 Card and thats what is supplied so from PCS Point there not doing anything wrong.

Nvidia have said on their Twitter page to contact them and they will try to help you out so i would send an email to their support address.

Thats the only thing i can think off.

Not been in touch with Palit about it, just PC S for the time being. The card works as I say, I expect
I will keep an eye on developments and see what happens. Ultimately Nvidia seem to be the ones who
have deceived people, whether anything actually happens about it remains to be seen. They are still
good cards. I would hope at least that the packaging etc. is changed and the real spec is made clear.

Well, finally got rid of stuttering (for the majority of the time)

I uninstalled the sound software package that came with PC, this made a little difference.
I overclocked my CPU to 4.6GHz (i also tried at 4.4GHz and result was similar) this made the biggest difference, now I'm guessing here there is some problem with CPU BOOST working correctly, like motherboard and CPU don't get on or maybe its the BIOS (i have latest BETA)
Specific to FarCry 4 I changed the AA to SMAA and it cured it even more I am A little disappointed that I can't use the recommended settings for this game on the Nvidia site but the difference between SMAA and FXAA is not noticeable to me at least normal AA causes stutters, never goes over 2GB of VRAM
Dying Light is now also smooth at full settings and view distance set to max at 1080 with v-sync

I realise all this is basically wild stabs in the dark but if it helps me there is a chance it could help someone else also that's why I'm sharing.

I have heard a few times about sound drivers being an issue for games stuttering. It was something that helped a bit for me when I had issues on CSGO.

Dying Light did get an update that did improve performance and it was CPU related. It had a lot of issues with too much being pushed onto a single core. They improved multi-threading by spreading it out rather than throwing it all on the first core. They also decreased the max view distance, which was also causing big problems even on the best of systems.

Just thought I would let people here know that Amazon are giving back between 10 to 20 percent partial refunds for customers that have bought a 970 recently. I just got £45 back from my evga 970 ftw I bought last month, which is 15% refund.

All I had to do was say that I read on reddit that others are getting a partial refund from amazon and they didnt even argue.

Pitty PC specialist wont do similar, although current games are OK im pretty sure this crappy slow VRAM will become a problem very soon

Apologies if this offends, but this idea of getting money back for this just smacks of today's compensation culture. I would hazard a guess and say that if nobody had been told about this, they would never have noticed a difference when gaming etc. BUT, someone told everyone, and all of a sudden people's worlds came crashing down as if nVidia had done something all together terrible.

I understand if the card is changed if you really aren't happy with it, but this idea of a partial refund in particular just grates.

(This reaction may or may not have been fuelled by an article I read this evening about a TA that was awarded something like £4000, plus the school had to pay £32000 in legal costs...because said assistant slipped and hurt her back...on a jigsaw piece! MADNESS!)

Must admit the idea of a partial refund is rather silly. However Nvidia (not Amazon, PCS, Palit etc) should be offering full refunds to those that want one.

You are 100% wrong in my case at least ask PCS if you like I have complained of stutters since day one long before this thread I was on another thread called frame hitching on GTX970 frame hitching
As for compensation culture we got crashed into the back of the works van the other day, slight jolt got out to see any damage and there was none, guy looked gutted, we said nvm and drove off, he seemed happier =), ofc we could have threw in a claim but my morals still exist, the rest of the world can sell its soul, ill keep mine thanks(abusing abulances gor a grand is disgusting and you all should feel very ashamed) so not everyone is here for the cash some are here because they paid out hundreds of hard earned cash for something that regaurdless of the VRAM issues does not work as intended
EG FC4 on NVIDIAHAHA website says use ultra and FXAA but this causes stutters constantly if I use SMAA its mostly good but still get the odd stutter / rubber banding

Funny thing is a NVIDIA admind has offered to help get a refund but he has not responded for weeks

Have you asked the retailer to help you out? If that doesn't work, contact the board manufacturer and give them a chance to help you. Let me know if you hit a dead end and I'll try to help.

That's good to know, thanks for telling me. This card has a new memory architecture and it's true that there is a small difference when going above 3.5GB. This article explains better than I can what the exact differences are, they vary a bit from game to game.
