Pre contractual EU Data Act Disclosure

The EU Data act (EU) 2023/2854 applies to some of the products that we provide, namely desktop, laptop, AIO, workstation and server computers.

None of the software, firmware or hardware shipped with our systems gathers data on behalf of PCSpecialist.

The systems inherently are not capable of gathering data without an operating system.

We have partnered with Microsoft Corporation (Microsoft) to offer our customers Microsoft Windows, though the hardware we provide may function with other operating systems should you opt to install this yourself.

We may also provide 3rd party software installed on the machine that may affect what data is gathered. Any such software will be disclosed to you at the point of sale, along with the option to opt in or out of having this software installed as applicable.

Typically, data is recorded from these 3rd parties in real time, this may vary dependent on the software you have installed.

Types of Data

The types of data recorded typically fall under one of two categories shown below.


  • Diagnostic data
    • Diagnostic data is typically separated further into mandatory and optional diagnostic data.

      The mandatory diagnostic data is used to ensure that software is kept up to date, secure and working as intended and serves to assist with diagnosing issues should you opt to share.

      Optional diagnostic data typically functions similar to mandatory diagnostic data, but for less critical software. Typically, you will be asked to opt into this diagnostic data, however this may vary depending on the software vendor.

  • Service data
    • Service data is collected and processed in order to allow some vendors to provide their goods and services and may be mandatory for you to use these goods and services. Typically this will be disclosed when software is installed, or the first time it is launched (before any data is collected) this may vary from vendor to vendor.

How data is stored

Storage of data is determined by each data controller. PCSpecialist does not collect and subsequently does not store any data automatically from our systems. There may be instances where you are asked to share diagnostic data from your system to assist in troubleshooting steps should you encounter an issue, depending on if the operating system you have elected to install supports this feature. Disclosure of this data is not mandatory but may affect what support we are able to provide should you choose not to disclose it.

Storage of data collected from software vendors typically will vary, please refer to their individual Data Act disclosures of the vendor. It may be the case that this data is immediately accessible by yourself when using the machine.

Your Rights

We do not collect and store any data gathered by your system automatically, as outlined in ‘How data is stored’ there may be instances where you voluntarily disclose things like program crash logs. You have a right to a copy of this data along with any other data in line with the General Data Protection Regulation (EU) 2016/679. This can be requested from our customer care team through our enquiries process.

Your rights to access data collected by 3rd parties may vary, please refer to the software vendors policy.

You have the right to lodge a complaint with the appropriate authority as outlined under article 37 of the EU data act, determined by the place of your habitual residence, place of work, or establishment.

Who your data is shared with

In exceptional circumstances, there may be cause for us to share diagnostic data with our partners as part of our fault finding or troubleshooting process. Under no circumstances will any data be shared with a party that does not have a legitimate interest in improving goods and services for the purpose of such. Should this occur, the data will be verified by ourselves to ensure that there is no identifiable information that links the information to yourself or any persons.

There may be circumstances where we have a legal duty to disclose information such as a mandatory disclosure of information request from law enforcement. In these instances, only the minimum amount of information will be disclosed in order for us to comply with our legal duty. We may be prevented from informing you of this disclosure.

3rd party software may vary on the sharing of data, please refer to their individual policies for further information on if and how they share data.

Termination of use of services

You may use our goods and services for as long as you wish, unless the provision of goods and services is terminated either by yourself or by PCSpecialist. You may also stop using our goods and services at any time. Should you wish to stop using our goods and services and have your information and account delated, please reach out to us through your regional PCSpecialist branch (contact information available on the website). This process is not reversible.
